This Privacy Policy (hereinafter “Privacy Policy”) describes how we, BMAsia (Thailand) Co. Ltd., collect, use, store and protects information (the "Data") that it collects from you during your use of the Site and BMAsia (Thailand) Co. Ltd.’s Internet radio streaming service (”BMAS”).
Our Privacy Policy only applies to the Data collected from individual human beings and will therefore only apply where either: a. You, as a potential or actual Subscriber, are an individual human being;


b. You, as an individual human being, are the authorised representative of a potential or actual Subscriber that is a legal person, for example a corporation

The following provisions of the Privacy Policy are to be understood and applied on this basis. The expression “you” in this Privacy Policy is to be understood to mean, according to the context, “you” as the subject of this privacy policy or “you” as the subscriber to BMAS.
In this Privacy Policy references to “we”, “us” and “our” are to BMAsia (Thailand) Co. Ltd.
By using the Site and BMAS, you agree to the collection and use of the Data in accordance with this Privacy Policy. If you do not agree to the terms of this Policy, please do not use the Site or BMAS.
By using the Site, you agree to the collection and use of your Data in accordance with the terms and conditions of this Privacy Policy. If you do not agree to the terms of this Policy, please do not use the Site or the Application.
  1. Data We Collect
    1. Data Collected from You
      We may collect Data directly from you in order to use the Site and BMAS. This requires you to provide during registration to use BMAS, both personal business information including your name, company name, location, username, password, email address, website, venue size, number of venues, etc. Only some of this information is mandatory where indicated during registration of your Account to use BMAS. Our registration web page clearly states which information is or is not mandatory at the time we collect it.
      If you subscribe to a free trial, where offered, or to a paying subscription of BMAS, you will have to provide credit card, PayPal or other payment information. This payment information is collected by us and transferred to and stored by our third-party payment processor. We will retain, store and use payment-related information limited to your transaction history, the expiration date of your subscription, expiry date of your credit card, method of payment, the email address associated with your Paid Subscription or a portion of your credit card number stored in an encrypted format.     2. Data We May Collect Automatically
      During your use of the Site and/or BMAS, we may automatically collect the following Data: Your IP address, device type, browser type, your device ID, unique identifiers (such as Android or iPhone ID), language, application version, the date and time you access the Site;
      Your type of subscription;

      Your activity on the Site and/or BMAS including without limitation the name or the number of radio channels you use, scheduling and your interactions with we support.
    3. Data we receive from Third Parties
      We may also receive Data about you from social network websites you may use to comment on the Site and BMAS.

      We will not be liable to you if a third party to whom you have given your consent to collect, use or share any Data violates its privacy policy or any data protection law or regulation.
  2. How We Use Your Data
    The Data that we collect may be used for following purposes:
    In order to set up and activate your account and/or subscription
    • Used to identify you when you log in on BMAS;
    Provide you access to the Site and allow you to use BMAS;
    Communicate with you, including updates, newsletters or emails about BMAS;
    Compile and analyze statistics regarding your visit and use of the Site or BMAS;
    Pay right holders for playlists that you listen to through the reports we send to such right holders;
    Prevent, detect, and investigate potentially prohibited or illegal activities, and enforce the Terms of Service;
    Compile aggregate data for internal and external business purposes;
    To respond to you about any comment or inquiry you have submitted; and
    To improve BMAS over time.
  3. How We Share Your Data
    We may share your Data with third parties as describes below:
    Share your Data with third parties who provide us with services but only for the purpose of providing such services to us;
    Our users Data may be aggregated to create statistics used to improve BMAS;
    We may disclose your Data pursuant to a law, regulation, or a decision by a regulatory or competent legal authority or, if deemed necessary, for the purpose of preserving our rights and interests of;
    We may share your Data when you have expressly consented to such disclosure.

    We recognise the importance of our users’ privacy and we have taken reasonable steps to protect your Data against loss, theft and unauthorized use, disclosure, or modification. However, we do not guarantee the security of your Data at any time during the use of the Site or Service.
  5. Data storage and transfer
    We retain Data for active accounts as long as we believe it is necessary and relevant for our operations.

    Additionally, once you have terminated your account, we may continue to store and use your Data for analytical purposes only and you hereby agree that we have the right to retain and use the Data for such purposes.
    Your Data may be transferred to servers which are in countries different from your registration and subscription information. You expressly consent to such transfer of your Data to jurisdictions outside of the jurisdiction from where you have subscribed to BMAS.

    You can access and modify some of your Data through the “My Account” tab on the Site of your account.
  7. Changes to the Privacy Policy
    We may amend this Privacy Policy from time to time. You can determine when this Privacy Policy was last revised by referring to the "Last Updated" legend at the top of this page. We will use reasonable efforts to notify you of changes to this Privacy Policy by posting the amended policy on the Site at least thirty (30) days before the effective date of the changes. Use of the Site following such changes constitutes your acceptance of the revised Privacy Policy then in effect.
